Is is very simple: OpenPLI is licenced under GPL.
Which means you can use the source as you please, as long as you publish it again. If you make modifications, you are required to publish the modifications.
You are not allowed to use code of which OpenPLi has the copyright as original author in your own product, and you are not allowed to re-use the code in software that is not GPL.
The license explicitly forbids this, so both teams that use OpenPLi as a basis, modify it and don't publish those changes, and companies that take solutions from the OpenPLi code to incorporate those in closed source are in violation of the license agreement. And in the second case they are also in violation of copyright laws, which means they are "thiefs" of the code we have the copyright of.

How do you know their closed-source C++ code does not contain something 'borrowed' from our open source C++ code?What all this fuss is about? DMM just switched to newer kernel and adopted interesting features that were already available in their competitors' products. They didn't copy OpenPLI and OpenPLI didn't steal anything from DMM.
