These licenses manufacturers of TVs or settop boxes do get when they officially are allowed to support CI+.... and for open source boxes you'll never get them officially. When a provider requires CI+ (the +) on a service the CI will not encrypt the service without a valid certificate. 

 

Usually also the hardware from such TV limits recordings, skip over advertisement in recordings and other limitations.... as the '+' is not something extra's, it are more '-' limitations....

Do I understand correctly that if the module supports legacy mode, then it will work normally unless a channel requires it?

Exactly.... E.g. here in the Netherlands the CI+ modules from M7 can do CI+... but as far I know they did not enable it yet on any services....
