The law in the Netherlands states that the retailer has the obligation to inform (especially since this is considered a "deviation from the norm"), and the customer has the obligation to enquire. So both are to blame.
That's only partially true. For normal to be expected functionality the buyer may assume that to be in order.
You don't need to inform yourself if your new car would be able to drive. But if it can't the retailer should inform you about that.
